2. Scope and Principles
This privacy policy applies to the mobile application Binaural Beats: Wave Sound Zen for iOS. We follow a "privacy by design" approach. The app is designed to function without user accounts and without third-party tracking/analytics (e.g., Firebase Analytics, Mixpanel, AppsFlyer).
Unless stated otherwise below, data is processed either locally on your device or by Apple as part of the App Store and iOS platform services.
3. Data Processing Details
3.1 Subscriptions & Purchases (Apple StoreKit)
If you purchase a subscription or premium content, the transaction is processed by Apple (App Store / StoreKit). We do not receive or store payment details (e.g., credit card numbers). To enable purchased features, restore purchases, and validate your entitlement status, the app may process purchase-related information provided by Apple, such as:
- Product identifier (which item/subscription was purchased)
- Purchase and renewal timestamps
- Subscription/entitlement status (active/expired/cancelled)
- Transaction identifier (a technical identifier generated by Apple for purchase validation and restoration; we use it only to verify transactions and enable purchased features)
Legal basis: Art. 6(1)(b) GDPR (Performance of contract).
3.2 Local Storage (App Settings)
To ensure the app functions as requested (e.g., remembering your favorite sessions, timer settings, or volume), this information is stored locally on your device. This data does not leave your device and is not accessible by us.
Legal basis: § 25(2) No. 2 TDDDG (Necessity for providing a requested service).
3.3 Support and Email Communication
If you contact us via email, we process your email address and the content of your message to handle your request and provide support.
Legal basis: Art. 6(1)(f) GDPR (Legitimate interest in customer support).
3.4 Diagnostics and Crash Reports
The app uses Apple’s standard diagnostic tools (Apple Crash Reporting). If a crash occurs, Apple may collect technical information (e.g., device model, operating system version, crash logs/stack traces) and make it available to us through Apple’s developer tools in aggregated or pseudonymized form, depending on your device settings and Apple’s platform behavior.
We use this information solely to analyze errors, improve stability, and fix bugs. We do not use it for advertising, profiling, or cross-app tracking.
Legal basis: Art. 6(1)(f) GDPR (Legitimate interest in app security and stability).
Right to Object (Art. 21 GDPR)
Where we process personal data based on our legitimate interests (Art. 6(1)(f) GDPR), you have the right to object at any time, for reasons arising from your particular situation.
If you object, we will stop processing your data unless we can demonstrate compelling legitimate grounds that override your interests, rights, and freedoms, or the processing serves the establishment, exercise, or defense of legal claims.
To exercise your right to object, contact us at: info@mkgames.org
4. Data We Do NOT Collect
To be fully transparent, we do not collect or process:
- Precise location data (GPS)
- Contact lists, photos, or personal files
- Health or biometric data
- Advertising identifiers (IDFA) or cross-app tracking data
- Personal profiles or behavioral analytics (No Firebase Analytics, No Mixpanel, No AppsFlyer, etc.)
5. Third-Party Services
The app does not integrate third-party analytics or advertising SDKs. However, the app uses Apple’s platform services for App Store purchases and Apple Crash Reporting as described above.
6. International Data Transfers
We do not operate our own servers for this app. Data related to App Store purchases and Apple diagnostics is processed by Apple under their responsibility. Apple may process data on servers located outside the EU/EEA. Please refer to Apple’s privacy information for details.
7. Data Retention
- Support Emails: Deleted after 12 months unless retention is required for legal purposes.
- Purchase Data: Processed as needed to validate entitlements and restore purchases.
- Local Data: Stored on your device until you delete the app or remove it within the app (if available).
8. Your Rights
Under the GDPR, you have the right to access, rectify, or erase your data, the right to restrict processing, the right to data portability (where applicable), and the right to withdraw consent at any time (where processing is based on consent).
You also have the right to lodge a complaint with the supervisory authority:
Berliner Beauftragte für Datenschutz und Informationsfreiheit
www.datenschutz-berlin.de
9. Children
This app is not specifically directed to children. We do not knowingly collect personal data from children. If you believe a child has provided us personal data via email support, please contact us so we can delete it.
10. Changes to This Policy
We may update this privacy policy from time to time to reflect changes in the app or legal requirements. The “Last updated” date at the top indicates when it was last revised.
